MCA to file an application to intervene in lawyer’s legal suit to declare vernacular schools unconstitutional



The MCA will be filing an application to intervene in lawyer Mohd Khairul Azam Abdul Aziz’s legal suit to declare vernacular schools unconstitutional.


I refer to my media statement from the 1st of November 2019, following the news of Mohd Khairul Azam Abdul Aziz’s legal suit seeking a declaration from the courts that Sections 28 and 17 of the Education Act 1996 to be in contradiction of Article 152 of the Federal Constitution.

Although his leave application to have his case heard by the Federal Court was dismissed Mohd Khairul Azam has since re-filed his application in the High Court. Should he win the suit, we may see all Chinese and Tamil vernacular schools in Malaysia declared unconstitutional, and face immediate shutdown or forced conversion into Malay-medium schools.

It is of utmost concern to MCA, as MCA is an organisation that upholds, champions and supports the right of the minority races in Malaysia to pursue an education in their preferred vernacular.

Therefore, the MCA has initiated the process to intervene in Mohd Khairul Azam’s suit via our lawyers, Messrs Ben Chan of Solaris Mont Kiara, and will be filing our application in due course.

It is to be noted that Mohd Khairul Azam has been drawing media attention to himself by initiating frivolous suits such as this in order to stir up racial tensions. His gleeful attitude announcing that he has “won” when SMK Pusat Bandar Puchong 1 issue flared up is proof of his true political intentions. The MCA will not stand silently by.
